Terms of Use

Please review these terms before using Whitley County Criminal History. Accessing a page, reading content, or running a search signals agreement with them. If you do not accept the terms, discontinue use.

NO FCRA USE. This privately operated website has no connection to a Whitley County, Kentucky, or federal agency. It and its advertising partners do not provide services for credit decisions, employment screening, tenant screening, insurance eligibility, or another Fair Credit Reporting Act (FCRA) purpose. This is neither a private investigation business nor a consumer reporting agency.

1. What This Website Is

This is a private reference site operated independently of government. It does not store official records, conduct official checks, retrieve criminal files, or submit documents for a visitor.

Its role is to identify Whitley County custodians, including the Circuit Court Clerk, local law-enforcement agencies, Kentucky State Police, and the Kentucky State Police Sex Offender Registry, along with optional outside research tools.

2. Rules for Using This Site

Use of the site is conditioned on these restrictions. You will not:

  • Violate a federal, Kentucky, or local law through site use
  • Threaten, stalk, intimidate, or harass a person with information found here
  • Use content for a credit, employment, tenant, or insurance decision
  • Attempt unauthorized entry into an account, server, or system
  • Deploy a bot, scraper, or other automated collection tool against the pages
  • Interfere with service availability or another visitor's access

3. No Harassment, Stalking, or Discrimination

No one may use information obtained here or through a linked service to threaten, stalk, harass, intimidate, or discriminate against another person. Kentucky State Police says registry data is published for awareness and safety, not punishment or embarrassment. Harassment based on Kentucky State Police Sex Offender Registry information may be prosecuted under KRS 525.070 and 525.080. Vigilante conduct is forbidden.

4. We Are Not a Consumer Reporting Agency

Whitley County Criminal History is not a consumer reporting agency under the FCRA and does not create a credit report, background check, or consumer report. Site content and linked tools may not be used to:

  • Determine creditworthiness or insurance eligibility
  • Evaluate an applicant or worker for employment
  • Assess a person for a lease or tenant decision
  • Decide eligibility for a license, permit, or government benefit
  • Carry out any other FCRA-regulated activity

A legally permitted check for such a purpose must use the appropriate official Kentucky State Police process or a provider that complies with the FCRA.

5. No Legal Advice

Site material is general information, not legal advice. A licensed Kentucky attorney should address how a warrant, charge, conviction, or expungement rule applies to a particular Whitley County matter.

6. No Warranties

All services and content are supplied "as is." There is no warranty that:

  • Any item is complete, accurate, or current
  • The service will remain available without interruption
  • The pages contain no defect, bug, or security weakness
  • An outside search provider will return complete or accurate results

Criminal records can change after filing, dismissal, sealing, or expungement. A gap or stale detail may remain. Only the record custodian can make an official statement or issue a certified copy.

7. Third-Party Services and Links

A link may lead to a court, law-enforcement agency, Kentucky office, legal resource, or outside search company. Those destinations are independently controlled. We do not accept responsibility for their content, prices, privacy practices, accuracy, or continued availability. Review their terms before use.

8. Intellectual Property

Whitley County Criminal History or its content partners owns the site's text, graphics, logos, and code. Written permission is required before copying, modifying, distributing, or creating derivative material.

9. Limits on Our Liability

To the maximum extent permitted by law, we are not responsible for damages arising from use of the site, its information, or a linked service.

10. Indemnification

You agree to defend and hold us harmless against a claim, demand, or legal action caused by your site use or breach of these terms, including related costs and legal fees.

11. Governing Law

Kentucky law governs these terms. A dispute arising from site use must be brought in a court located in Kentucky.

12. Changes to These Terms

These terms may be revised. Updated terms become effective when posted on this page.

13. Cutting Off Access

Access may be restricted or terminated at any time, without advance notice.

14. Severability

If one provision is held invalid or unenforceable, the remaining terms continue in effect. The affected provision will be changed only to the extent needed for enforcement.
